These Terms of Service ("Terms") govern your access to and use of CourtLingual, the court interpreter marketplace operated by CourtLingual ("we", "us", "our"). By creating an account, posting a gig, applying for a gig, or otherwise using the platform, you agree to these Terms. If you do not agree, do not use the platform.
Interpreter Eligibility
To offer services through CourtLingual, you must:
- Hold an active interpreter certification recognized in the jurisdiction where the gig will be performed.
- Only offer services in language pairs for which you hold a current, valid certification.
- Keep your certifications, language pairs, and expiration dates accurate and up to date on your profile.
- Promptly upload supporting documentation when we request it for verification.
CourtLingual may remove interpreters from the marketplace, withhold payment, or terminate accounts that do not meet these eligibility requirements.
Court Responsibilities
When you post a gig or book an interpreter through CourtLingual, you agree to:
- Provide accurate booking information, including date, time, location, language pair, and any on-site requirements.
- Give prompt cancellation notice when a gig no longer needs to proceed.
- Honor confirmed bookings. A booking becomes "confirmed" once both parties have accepted it through the platform.
- Pay the gig rate and applicable platform fees in accordance with the "Payments" section below.
- Treat interpreters with professional respect and provide a working environment consistent with the dignity of the proceeding.
Gig Cancellation Fees
Cancellation fees protect interpreters who turn down other work to honor a confirmed booking. Fees are calculated from the start time of the gig:
| Notice given | Fee to interpreter |
|---|---|
| More than 48 hours before gig start | No cancellation fee |
| Between 24 and 48 hours before gig start | 50% of the gig rate |
| Less than 24 hours before gig start, or no-show by the court | 100% of the gig rate |
| Interpreter no-show | Court is not charged; interpreter forfeits the gig fee |
Both parties can document a cancellation reason through the platform; in disputed cases, CourtLingual's dispute-resolution process applies.
Gig Completion Standards
Interpreters agree to:
- Arrive on time, prepared, and in appropriate professional attire.
- Conduct themselves with the neutrality, accuracy, and confidentiality required of a court interpreter.
- Notify the court and CourtLingual as soon as reasonably possible of any issue that prevents safe or accurate performance.
- Decline assignments they are not certified or prepared to perform.
Off-Platforming Prohibition
All conversations, scheduling, payments, and reviews must take place on CourtLingual for any engagement that began on the platform. You may not:
- Use CourtLingual to find a court, interpreter, or contact, then complete the booking outside the platform.
- Request, offer, or accept payment through any channel other than CourtLingual's payment system.
- Share direct contact information for the purpose of routing a booking off-platform.
Engaging in off-platform transactions is grounds for immediate account termination and may forfeit any unpaid fees.
Payments and Fees
- Interpreter-set rates: interpreters set their own rates for each gig; the rate is disclosed to the court before booking confirmation.
- Platform fee: a platform fee (shown as a percentage of the gig rate) is disclosed on the booking summary before the court confirms. By confirming the booking, the court agrees to the fee.
- Interpreter payout: interpreters are paid within 7 business days of gig completion, less the platform fee.
- Court invoicing: courts are invoiced net 30 from gig completion. Payment terms may vary by subscription tier.
- Taxes: each party is responsible for its own tax obligations. Earnings may be reported as required by tax authorities.
Liability
To the maximum extent permitted by law:
- Our total liability for any claim arising out of or related to the platform is limited to the greater of (a) the fees you paid us in the 12 months before the claim, or (b) US $500.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
- Nothing in these Terms limits liability that cannot be excluded under applicable law (such as liability for fraud, death, or personal injury caused by negligence).
Indemnification
You agree to indemnify, defend, and hold harmless CourtLingual and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the platform, (b) your conduct in connection with a gig, (c) your violation of these Terms, or (d) your violation of any applicable law or third-party right.
Dispute Resolution
If a dispute arises between you and another user, or between you and CourtLingual, we encourage you to contact us first to seek an informal resolution:
If the dispute is not resolved within 60 days of submission, you agree that the dispute will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Travis County, Texas, and the arbitrator's award may be entered in any court of competent jurisdiction.
Class action and jury trial waiver: you waive the right to participate in any class, collective, or representative action against CourtLingual and waive any right to a jury trial.
Account Termination
CourtLingual may suspend or terminate your account at any time, with or without notice, for reasons including but not limited to:
- Violation of these Terms or our policies.
- Fraud, misrepresentation, or misuse of the platform.
- Off-platforming or attempting to circumvent our payment system.
- Non-payment of fees owed.
- Verified complaints regarding credential fraud, professional misconduct, or conduct that puts court participants at risk.
You may close your account at any time by contacting contact@courtlingual.com; pending payouts for completed gigs will still be processed.
Modifications
We may update these Terms from time to time. If we make material changes, we will notify you by email and by posting a notice in the platform at least 30 days before the changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
